1. Agreement to Terms

By accessing or using Pet CareVault ("Service"), operated by For When I Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

2. Description of Service

Pet CareVault provides a secure digital platform for storing, organizing, and sharing pet care information. The Service allows you to:

• Store pet care instructions, medical records, and related documents
• Grant access to designated long-term caregivers and emergency contacts
• Share information via secure links or QR codes
• Provide tools to help users prepare for and facilitate pet care handoffs

3. Account Terms

Account Creation

• One account per person only
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access

Account Transfer Upon Death

In the event of an account holder's death:

• Account may be transferred to designated long-term caregiver or estate executor
• Valid death certificate required
• We do not mediate disputes between potential successors
• Transfer follows documented user preferences only

Age Requirements

While we require account holders to be 18+, we do not verify the age of every designated long-term caregiver or emergency contact. Users are responsible for their designation decisions.

5. Prohibited Uses

The Service is intended solely for pet care record keeping and sharing. You may NOT use the Service to:

• Store documentation of animal abuse or neglect
• Facilitate illegal breeding operations
• Document pet fighting or other illegal activities
• Traffic in endangered species
• Store human medical information (NOT HIPAA compliant)
• Violate any applicable laws or regulations

6. User Content

Content Ownership

• You retain ownership of all content you upload
• You grant us a license to store and display your content as necessary to provide the Service
• We may use anonymized data to improve our Service

Your Responsibility

You are solely responsible for:

• Accuracy of all information you store
• Ensuring you have rights to upload content
• Consequences of sharing access with others
• Keeping information current and updated

7. Limitation of Liability

This limitation applies even if we knew or should have known about the possibility of damages.

8. Indemnification

You agree to defend, indemnify, and hold harmless For When I Inc., its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Content you upload, including accuracy of pet care instructions
• Actions of those you grant access to
• Any veterinary malpractice claims related to stored instructions
• HIPAA violations from uploading human medical data
• Disputes over account access or pet custody

This includes paying our attorney fees if we have to defend against claims related to your actions.

9. Disclaimers

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Veterinary Advice

PET CAREVAULT DOES NOT PROVIDE VETERINARY OR MEDICAL ADVICE. We are not veterinarians and make no representations about the accuracy or appropriateness of any pet care information stored on our platform.

Always consult with a qualified veterinarian for pet health decisions.

Not HIPAA Compliant

This Service is NOT designed, intended, or certified for storing human health information. We are NOT a HIPAA-covered entity. Any human medical information uploaded is at your sole risk with NO privacy protections.

No Emergency Guarantee

We cannot guarantee that emergency responders or any other persons will scan QR codes, that codes will remain readable, or that the Service will be available during emergencies. Users must maintain backup emergency plans.

10. Termination

Termination by Pet CareVault

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Illegal activities
• Uploading prohibited content
• Non-payment of fees
• Any reason at our sole discretion

Termination by You

You may cancel your subscription at any time. Refunds are not available for voluntary cancellation after 30 days, except where required by applicable law.

Effect of Termination

Upon termination:

• Access to your account will be disabled
• We may delete your data after 30 days
• You remain liable for fees incurred
• Indemnification obligations survive termination

11. Dispute Resolution & General Terms

Informal Resolution Required First

Before filing any legal action, you MUST attempt to resolve disputes informally:

1. Send us a message choosing "Dispute Resolution"
2. We have 30 days to respond to your complaint
3. After we respond, we both have 30 days to resolve the issue
4. Only after this process may either party file legal action
5. The statute of limitations is tolled during this informal process

Both parties agree to make good faith efforts to resolve disputes before legal action.

Governing Law & Formal Disputes

• These Terms are governed by Minnesota law
• After informal resolution fails, disputes go to binding arbitration in Minnesota
• You waive any right to class action lawsuits
• If you lose, you pay our attorney fees

Changes to Terms

We may modify these Terms at any time. Changes are effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

Force Majeure

We are not liable for failures due to circumstances beyond our control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, internet failures, or power outages.

Service Availability

We strive for 99% uptime but do not guarantee uninterrupted service. We depend on third-party providers and cannot be held liable for their failures.

Severability

If any provision of these Terms is found invalid, the remaining provisions continue in full effect.

California residents under 18 years old may request removal of content they posted:

• Contact us and choose "Removal Request"
• Describe the content and where it's located
• We'll remove content you posted while under 18
• Note: Removal doesn't ensure complete deletion from all systems

"Shine the Light" Law

California residents may request information about disclosure of personal information to third parties for marketing purposes. We do NOT share your personal information with third parties for their marketing purposes.
